Terms of Image Use

Sporting Club Packages

1. Copyright retained by Fallen Tree Collective

All images produced under this agreement remain the intellectual property of Fallen Tree Collective. Payment for services does not constitute a transfer of copyright.

2. Permitted client use

Match Day and Club Highlights images are licensed for organisational use (social media, website, newsletters, print) and may be shared with parents and members for personal, non-commercial use. Club Fundraiser images are for organisational use only — individual and family purchases are made exclusively via Fallen Tree Collective’s online gallery.

3. No third-party distribution — Club Fundraiser Package only

High-resolution images provided to the club under the Club Fundraiser package are not to be distributed to individual members, parents, or third parties in any format — digital or print. This protects the fundraiser model, where individual downloads directly benefit the club ($2 per download returned to club funds).

4. Individual sales rights reserved

The right to sell images to individual members, families, or third parties is exclusively reserved by Fallen Tree Collective unless otherwise agreed in writing.

5. Portfolio use

Fallen Tree Collective reserves the right to use any images (cleared with the club prior) produced for promotional and portfolio purposes, including on our website and social media channels.

6. Image delivery and retention

Edited galleries will be delivered within 14 business days of the shoot (or, for Club Highlights, on an ongoing basis across the season). Fallen Tree Collective will retain original files for a period of 12 months from the date of delivery, after which files may be archived or deleted.

7. Credit and attribution

Where images are shared publicly by the club (social media, website, print), the club agrees to credit Fallen Tree Collective where reasonably practicable (e.g. photo tag or caption credit).

8. Cancellation and rescheduling

In the event of cancellation due to weather, fixture changes, or other circumstances outside Fallen Tree Collective’s control, the shoot will be rescheduled at no additional cost where possible. Cancellations made by the client with less than 48 hours notice may incur a fee of 20%.

9. Agreement

Payment of invoice constitutes acceptance of these terms. Any variation to these terms must be agreed in writing prior to the shoot.
